Welcome to Shua Studios™. These Terms of Service govern your use of ShuaStudios.com, purchases made through the website, and other orders or services that specifically reference these Terms.

Throughout these Terms, “Shua Studios,” “we,” “us,” and “our” refer to Shua Studios™.

By accessing this website, creating or submitting an order, or purchasing a product or service from Shua Studios™, you agree to these Terms of Service, our Privacy Policy, Shipping Policy, Return & Refund Policy, and any product-specific or custom-order terms provided before purchase.

If you do not agree with these Terms, please do not use the website or place an order.

About Shua Studios™

Shua Studios™ is an independent Iowa sole proprietorship based in Sioux City, Iowa.

Shua Studios™ is built around original artwork, apparel, symbolic design, custom creative work, Little Shuas™, the philosophy of Nothing Stands Alone, and related creative collections.

Products may include apparel, accessories, artwork, prints, handmade goods, custom or personalized items, collaborative products, and other creative merchandise.

Products may be designed, produced, printed, pressed, packaged, or fulfilled directly by Shua Studios™ or through trusted production and fulfillment partners. These partners may include print-on-demand providers, apparel suppliers, professional printers, transfer producers, shipping carriers, and other vendors.

Digital Products and Downloads

Digital products sold by Shua Studios™, including downloadable PDFs, coloring books, artwork files, and other electronically delivered content, are licensed to the purchaser for personal use unless a product listing expressly states otherwise.

Purchasing a digital product does not transfer ownership of the underlying artwork, characters, trademarks, copyrights, or other intellectual property. Digital products may not be resold, redistributed, uploaded for public access, reproduced for commercial use, or otherwise shared in a way that violates Shua Studios™ intellectual property rights.

Access to digital products may depend on the purchaser providing a valid email address and using a compatible device, browser, software, or printer. Refund eligibility for digital products is governed by the Shua Studios™ Return & Refund Policy.

Analytics, Advertising, and Third-Party Technologies

Shua Studios™ may use third-party analytics, advertising, ecommerce, and marketing technologies, including services provided by Squarespace, Google, Meta Platforms, Inc., Facebook, and Instagram. These technologies may collect or receive information about website activity as described in the Shua Studios™ Privacy Policy. Use of ShuaStudios.com constitutes acknowledgment that certain website functions depend on third-party services that are also governed by their own terms and privacy practices.

Eligibility and Purchases by Minors

You must be at least 18 years old or have the involvement and permission of a parent or legal guardian to place an order.

Although some Shua Studios™ products are designed for children, purchases must be completed by an adult or under an adult’s supervision.

If you place an order on behalf of a business, organization, or another person, you confirm that you have authority to do so.

Use of This Website

You may use this website for lawful, personal, and shopping-related purposes.

You may not:

• Interfere with the website’s security or operation.

• Attempt unauthorized access to accounts, systems, or information.

• Use automated tools to scrape, download, collect, or extract website content.

• Copy, trace, reproduce, modify, or commercially use protected artwork or content.

• Upload malicious code, viruses, or harmful material.

• Impersonate another person or submit false information.

• Use the website or its content for fraud, harassment, unlawful activity, or infringement of another person’s rights.

• Use Shua Studios™ artwork or content to train, test, develop, prompt, or supply datasets for artificial intelligence or generative systems without written permission.

We may restrict access to the website when reasonably necessary to protect Shua Studios™, our customers, our intellectual property, or the security of the website.

Products and Availability

Products are subject to availability. Some products are kept in stock, while others are made to order, custom produced, handmade, or fulfilled by a production partner after an order is placed.

Placing an item in a shopping cart does not reserve it.

We may add, change, discontinue, or limit products, colors, sizes, materials, collections, or quantities at any time. Changes will not affect an order already accepted unless we contact you and receive your approval.

We will not make a material substitution to an accepted order without notifying you and obtaining your agreement.

Product Images, Colors, Sizing, and Variations

We make reasonable efforts to display products, colors, artwork, sizing, materials, and descriptions accurately.

Actual colors may vary slightly because of screen settings, lighting, garment dye lots, material differences, printing methods, transfer production, handmade processes, and normal manufacturing variations.

Placement and size of printed artwork may vary slightly between garment sizes or individually produced items.

Handmade or hand-finished products may contain minor variations in shape, texture, color, finish, or placement. These natural variations are part of the product and are not considered defects when the item remains consistent with its description.

Customers are responsible for reviewing the size chart, product description, material information, care instructions, and available options before ordering. Sizing may differ between brands and garment styles.

Prices, Taxes, and Promotions

All website prices are listed in U.S. dollars unless otherwise stated.

You agree to pay the product price, shipping charge, applicable sales tax, and any other amount clearly shown before you submit the order.

At the time of this update, standard website shipping within the United States is $4.99 per order unless a product page, promotion, or checkout states otherwise. The final amount displayed at checkout controls.

Prices, sales, discount codes, and promotions may change without notice. A promotion does not apply retroactively to a previous purchase unless we specifically state otherwise.

Discount codes may be limited by date, product, order amount, or number of uses and may not be combined unless allowed.

If a product is listed with an obvious pricing, description, or technical error, we may correct the error and cancel the affected order. If payment was already collected, we will issue a full refund for the canceled item or order.

Orders and Order Acceptance

You are responsible for providing accurate and complete information, including your name, email address, billing information, shipping address, product selections, sizes, colors, quantities, spelling, and customization details.

An automated order-confirmation email acknowledges that we received your order. It does not guarantee that the order can be fulfilled.

We may refuse or cancel an order for reasons including:

• Failed or unauthorized payment.

• Suspected fraud or misuse.

• Incorrect or incomplete customer information.

• Product or material unavailability.

• A pricing or website error.

• An order requesting unlawful or infringing content.

• An address outside an area we currently serve.

• Another reasonable concern affecting our ability to complete the order safely or lawfully.

If we cancel an order after collecting payment, we will refund the canceled portion unless the amount is lawfully owed for completed custom work or another charge that was clearly agreed to in advance.

Payments

Payments are processed through secure third-party payment providers. Shua Studios™ does not directly store complete payment-card information.

By submitting an order, you confirm that you are authorized to use the selected payment method and authorize the amount displayed at checkout.

Payment-provider authorization or processing delays may affect when an order enters production.

Made-to-Order Products and Production

Many Shua Studios™ products may enter production shortly after an order is submitted. Production methods may include print-on-demand fulfillment, outsourced professional printing, DTF transfer production, in-house heat pressing, handmade production, or a combination of these methods.

Production and delivery estimates are estimates rather than guarantees. However, we will make reasonable efforts to meet any shipping timeframe stated before purchase.

If no shipping timeframe is stated, we will have a reasonable basis to expect shipment within 30 days. If we cannot ship within the promised timeframe—or within 30 days when no timeframe was provided—we will notify you of the delay, provide an updated estimate, and explain your option to accept the delay or cancel the unshipped portion for a prompt refund, as required by applicable law.

Orders containing multiple products may be produced by different providers and may arrive in separate packages.

Shipping and Delivery

Website checkout is currently limited to shipping addresses within the United States unless the website specifically offers another destination.

Shipping time may depend on production time, product type, fulfillment location, shipping carrier, destination, weather, holidays, demand, and other circumstances.

Carrier delays and tracking interruptions may occur after shipment. These circumstances do not eliminate any cancellation or refund rights provided by applicable law.

You are responsible for entering a complete and accurate delivery address. Contact shua@shuastudios.com immediately if you notice an address error. We cannot guarantee that an address can be changed after production or shipment begins.

If an order is returned because the customer supplied an incorrect or incomplete address, the customer may be responsible for reasonable additional shipping costs before the order is sent again.

If tracking shows a package as delivered but you cannot locate it, check the delivery area, household members, neighbors, and carrier information, then contact the carrier and Shua Studios™ promptly. We will reasonably assist with available carrier or fulfillment-provider procedures.

Local Pickup and Delivery

Local pickup or delivery may be available by arrangement within the Shua Studios™ Siouxland service area only when it is offered at checkout or separately confirmed by Shua Studios™ in writing.

Customers must wait until Shua Studios™ confirms that the order is ready and provides the meeting, pickup, or delivery location, time, and instructions. Selecting, discussing, or requesting local pickup or delivery does not guarantee availability or mean that an order is immediately ready.

Shua Studios™ is a service-area business and does not operate a public retail storefront. Our private home workspace is not a public pickup location. Customers must not arrive without a confirmed arrangement.

Any applicable local-delivery charge, eligibility, and estimated timing will be displayed at checkout or confirmed in writing before delivery. Additional details are provided in the Shua Studios™ Shipping Policy.

Returns, Refunds, Replacements, and Exchanges

Returns, refunds, replacements, and exchanges are governed by the Shua Studios™ Return & Refund Policy. The following is a summary of the primary rules.

Because many products are made to order, custom produced, personalized, or printed specifically for the customer, we generally do not accept returns or provide refunds for:

• Buyer’s remorse or change of mind.

• Accidental orders.

• Incorrect size, color, or product selections made by the customer.

• Failure to review a size chart or product description.

• Minor color, placement, handmade, or manufacturing variations described in these Terms.

• Damage caused by misuse, improper care, laundering contrary to instructions, normal wear, or alteration after delivery.

If an item arrives damaged, defective, misprinted, or materially different from what was ordered, contact shua@shuastudios.com within 14 days after delivery.

Include your order number, a description of the problem, and clear photographs showing the item and the issue. Do not mail an item back unless we provide return instructions.

After reviewing an eligible claim, Shua Studios™ may provide a replacement, repair, store credit, partial refund, or full refund, depending on the circumstances and applicable law.

If a return is required because Shua Studios™ or a fulfillment provider sent an incorrect, damaged, or defective item, we will provide instructions and cover reasonable approved return-shipping costs.

Approved refunds are generally returned to the original payment method. The time required for a refund to appear may depend on the payment provider or financial institution.

Nothing in these Terms removes any warranty, refund, replacement, cancellation, or consumer right that cannot legally be waived.

Order Changes and Cancellations

Contact shua@shuastudios.com as soon as possible if you need to request an order change or cancellation.

A cancellation or change request is not effective until Shua Studios™ confirms it in writing.

Because made-to-order and custom products may enter production quickly, we cannot guarantee changes or cancellations after an order is submitted.

Once production, printing, pressing, personalization, or custom design work has begun, an order generally cannot be canceled, changed, or refunded unless the product is defective, incorrect, delayed beyond an accepted timeframe, or applicable law requires another result.

If we approve a cancellation before production begins, we will refund the canceled amount to the original payment method.

Custom and Personalized Work

Custom orders may be subject to a written quote, invoice, design brief, proof, approval message, or other order-specific terms. Those written details become part of the agreement for that order.

Customers are responsible for reviewing proofs and confirming spelling, dates, names, colors, sizing, artwork placement, and other requested details before approval.

Once a customer approves a proof or design, Shua Studios™ is not responsible for an error that appeared clearly in the approved version. We remain responsible for production that materially differs from the approved version.

Changes requested after approval may require additional payment and production time. We will disclose and obtain approval for any additional charge before continuing.

Unless a written agreement states otherwise:

• Shua Studios™ retains ownership of original artwork, design concepts, sketches, layouts, and other creative material developed by Shua Studios™.

• Payment for a custom product does not automatically purchase the copyright or exclusive rights to the underlying artwork.

• Unused concepts, drafts, and rejected designs remain the property of Shua Studios™.

• Any transfer of copyright, exclusivity, commercial rights, reproduction rights, or tattoo-use rights must be stated in a separate written agreement.

Customer-Provided Artwork and Materials

If you provide artwork, photographs, logos, names, text, trademarks, or other material for a custom order, you confirm that you own the material or have permission to use and reproduce it for the requested purpose.

You grant Shua Studios™ and necessary production partners a limited license to access, reproduce, adjust, and use the submitted material only as reasonably necessary to communicate with you and complete the order.

You are responsible for claims caused by material you submitted without the required ownership, permission, or authorization.

We may refuse material that we reasonably believe is unlawful, infringing, threatening, deceptive, hateful, exploitative, or otherwise inappropriate for Shua Studios™ to produce.

Customer Content, Photos, Messages, and Reviews

You retain ownership of photographs, reviews, testimonials, messages, and other original content you create.

Nothing in these Terms restricts your right to provide an honest review or share an honest opinion about Shua Studios™, its products, services, or customer service.

If you publicly tag Shua Studios™ in a post or send content with a clear invitation or permission to share it, you grant us a nonexclusive, royalty-free license to display or repost that specific content on our website and Shua Studios™ social-media accounts.

We will not intentionally misrepresent your words. You may withdraw permission for future use by contacting shua@shuastudios.com. Removal may not affect material already lawfully printed, published, or scheduled before the request was received.

Private messages, private photographs, personal information, and customer-service communications will not be publicly used for advertising or promotion without permission.

Intellectual Property

Unless otherwise stated, all Shua Studios™ website content—including original artwork, Little Shuas™ characters, designs, logos, graphics, product images, photographs, written material, stories, names, branding, layouts, concepts, and other creative content—is owned by the owner of Shua Studios™ or used with permission.

All rights are reserved.

You may view the website, share links to public pages, photograph a legitimately purchased product, give the product as a gift, write an honest review, and resell an individual genuine physical item you lawfully own.

Purchasing a physical product gives you ownership of that physical item. It does not transfer copyright, trademark rights, reproduction rights, commercial rights, tattoo rights, digital rights, or ownership of the artwork printed or displayed on it.

Without prior written permission, you may not:

• Copy, scan, download, trace, redraw, reproduce, print, manufacture, or distribute Shua Studios™ artwork.

• Remove artwork from a product image or recreate it as a separate design.

• Modify artwork or create derivative products for sale or distribution.

• Upload artwork to another printer, print-on-demand provider, marketplace, website, or social-media shop for reproduction.

• Use artwork for apparel, merchandise, tattoos, logos, branding, advertising, digital products, NFTs, or promotional material.

• Sell counterfeit or unauthorized Shua Studios™ products.

• Use Shua Studios™ content as artificial-intelligence training data, reference material, prompts, datasets, model inputs, or generative outputs.

If you believe content on ShuaStudios.com infringes your copyright, trademark, or other rights, contact shua@shuastudios.com with:

• Your name and contact information.

• Identification of the protected work or right.

• The location of the material on the website.

• An explanation of why you believe the use is unauthorized.

• A statement that the information you provided is accurate and submitted in good faith.

We will review properly submitted concerns and take reasonable action when appropriate.

Product Care and Safety

Customers must follow product descriptions, care labels, washing instructions, safety notices, and use restrictions.

Products marked as decorative, not food-safe, not dishwasher-safe, not microwave-safe, not waterproof, not a toy, or intended for a particular age or use must be treated according to those instructions.

Do not use a product for a purpose that conflicts with its description or safety information.

Contact Shua Studios™ before ordering if you need clarification about materials, garment content, care, allergies, sensitivities, or intended use.

Creative and Informational Content

Shua Studios™ artwork, writing, philosophy, commentary, stories, product descriptions, and other creative content are provided for artistic, personal, cultural, entertainment, or informational purposes.

Nothing on the website should be interpreted as medical, legal, financial, mental-health, religious, tattoo-safety, or other professional advice.

Third-Party Services and Links

Shua Studios™ may use third parties for website hosting, payments, printing, production, order fulfillment, shipping, analytics, email, and other business functions.

These providers may have their own terms and privacy practices. Use of a third party’s separate website or service is subject to that provider’s policies.

Production partners assist Shua Studios™ with fulfilling orders, but customers should contact Shua Studios™ at shua@shuastudios.com regarding an order placed through ShuaStudios.com.

The website may contain links to third-party websites or social platforms. Shua Studios™ is not responsible for the independent content, security, availability, or practices of those external sites.

Website Availability and Changes

We may update, correct, reorganize, pause, restrict, or remove portions of the website when reasonably necessary.

We do not guarantee that the website will always be uninterrupted, error-free, or available on every device or browser.

Website changes will not remove obligations connected to an already accepted order.

Disclaimer of Warranties

We make reasonable efforts to provide accurate descriptions and properly produced products.

Except for promises expressly made in these Terms, a product description, an approved custom-order agreement, or rights that cannot be waived under applicable law, the website and its content are provided on an “as available” basis.

We do not guarantee that the website will meet every individual expectation or that a product will be suitable for a purpose that was not disclosed or described before purchase.

Limitation of Liability

To the fullest extent permitted by law, Shua Studios™ will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or a product, including lost profits, lost opportunities, or lost data.

To the fullest extent permitted by law, Shua Studios™’ total liability for a claim relating to a particular product or order will not exceed the amount paid for the product or order giving rise to the claim.

These limitations do not apply to an obligation specifically stated in these Terms, fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any liability or consumer right that cannot legally be limited or excluded.

Events Outside Reasonable Control

Shua Studios™ is not responsible for a failure or delay caused by events outside our reasonable control, including severe weather, natural disasters, carrier interruptions, supply shortages, labor disruptions, government actions, widespread service outages, or production-partner emergencies.

We will still communicate material delays and provide cancellation or refund options when required by applicable law.

Governing Law and Disputes

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection laws apply.

Any legal proceeding relating to these Terms or an order must be brought in an appropriate state or federal court serving Woodbury County, Iowa, unless applicable law permits or requires a different location.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court.

Before beginning a formal dispute, we encourage you to contact shua@shuastudios.com so we have a reasonable opportunity to understand and address the concern.

Changes to These Terms

We may update these Terms of Service when Shua Studios™ changes its products, services, operations, policies, or legal obligations.

Updates will be posted on this page with a revised “Last updated” date.

Changes apply prospectively. An order already placed will remain subject to the version of the Terms and order-specific information in effect when the order was submitted, unless both parties agree otherwise or applicable law requires a change.

Severability and Waiver

If any portion of these Terms is found unenforceable, the remaining portions will continue in effect to the fullest extent permitted by law.

A failure by Shua Studios™ to enforce a provision on one occasion does not permanently waive the right to enforce it later.

Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Return & Refund Policy, product description, checkout information, and any written custom-order terms, form the agreement between you and Shua Studios™ regarding your website use or purchase.

If an order-specific written agreement directly conflicts with these Terms, the order-specific agreement controls only for that order.
